1. Introduction
Welcome! These Terms and Conditions (“Terms”) govern your access to and use of all mobile applications (“Apps”) provided by FTS LLC (“we,” “us,” or “our”). By downloading, installing, or using any of our Apps, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Apps.
2. Apple App Store Specific Terms
Since our Apps are downloaded from the Apple App Store, the following terms apply:
Acknowledgment: You and FTS LLC acknowledge that these Terms are concluded between you and FTS LLC only, and not with Apple Inc. (“Apple”). FTS LLC, not Apple, is solely responsible for the Apps and their content.
Scope of License: The license granted to you for the Apps is a non-transferable license to use the Apps on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Maintenance and Support: FTS LLC is solely responsible for providing any maintenance and support services with respect to the Apps. Apple has no obligation whatsoever to furnish any maintenance and support services regarding the Apps.
Warranty: Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
3. Subscriptions and In-App Purchases
Our Apps may offer auto-renewing subscriptions that grant access to premium features or content.
Subscription Plans:
We offer two types of auto-renewing subscriptions:
Monthly Subscription: Billed automatically every 1 month.
Annual Subscription: Billed automatically every 1 year.
Billing and Auto-Renewal Rules:
Payment will be charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication, where applicable.
4. Intellectual Property
The Apps, including all design, text, graphics, and underlying source code, are the exclusive property of FTS LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Apps without our explicit written consent.
5. Limitation of Liability
To the maximum extent permitted by law, FTS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Apps; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Jurisdiction/Country, e.g., Ukraine / the State of Delaware], without regard to its conflict of law provisions.
7. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by updating the “Last Updated” date at the top of these Terms. Your continued use of the Apps after any such changes constitutes your acceptance of the new Terms.
